1. Acceptance of Terms

These terms (“Terms of Use”), between you, the user of the Coags application and the services offered thereunder (the “App”), and the American Society of Regional Anesthesia and Pain Medicine  (“ASRA Pain Medicine”), will become effective on the date that you download, access and/or use the App (“Effective Date”) and, by downloading, accessing, or using the App, you agree to comply with and be bound by these Terms of Use. If you do not agree to these Terms of Use, you may not use the App.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase a Subscription.

3. Account Registration

To access certain features, users may be required to create an account. In the process of creating and/or maintaining your account, you agree to:

• Provide accurate and current information;
• Maintain the confidentiality of your login credentials and account information;
• Notify us promptly of unauthorized account access.

You are responsible for all activity under your account.

4. Subscription Services

Certain features of the App are available through paid subscription plans (“Subscription”).

Subscription Terms

• The Coags subscription-based app is $6.99/annually or free with a fully paid ASRA Pain Medicine membership.
• “Term” means the period during which these Terms of Use remain in effect, beginning on the Effective Date and continuing until terminated in accordance with these Terms of Use.

• Your Subscription Term will automatically renew unless canceled before the renewal date, which occurs on each one-year anniversary of the Effective Date.

• Billing occurs through the applicable app store or payment provider.
• By subscribing, you authorize recurring charges based on your selected Subscription plan.

5. Free Trials

If offered, free trial periods automatically convert to paid subscriptions unless canceled prior to the trial end date.

6. Cancellation Policy

Subscription Cancellation

Users may cancel their Subscription at any time, but only through the following methods:

• The Apple App Store;
• Google Play Store;
• The user account settings within the App;
• Contacting [email protected];

Cancellation requests must be completed before the next billing cycle to avoid automatic renewal charges.

Effect of Cancellation

Upon cancellation:

• Your subscription will remain active through the end of the current billing period.
• Access to the App and the license to use the App will terminate at the conclusion of the paid Subscription Term.
• No partial-month or unused-period credits will be issued unless required by law.

Refund Policy

Except where required by applicable law:

• Subscription fees are non-refundable.
• Refund requests for Subscriptions purchased through Apple or Google must be directed to the applicable app store provider.
• Promotional or discounted Subscriptions are non-refundable.

Free Trial Cancellation

Users may cancel a free trial at any time before the trial expiration date to avoid being charged.

Billing Disputes

If you believe you were charged in error, please contact [email protected] within fifteen [15] days of the date of the charge believes to be in error.

Changes to Subscription Pricing

We reserve the right to modify Subscription pricing upon reasonable notice. Continued use of the Subscription after the Effective Date of the notice of price change constitutes acceptance of the new pricing.

Account Deletion

Deleting the App does not automatically cancel your subscription. Users must separately cancel recurring subscriptions through the applicable billing platform.

7. User Conduct

You agree not to:

• Use the App for unlawful purposes;
• Attempt to gain unauthorized access to systems or accounts;
• Interfere with App functionality or security;
• Copy, distribute, or exploit App content, code and/or guidelines without express written authorization from ASRA Pain Medicine;
• Upload harmful code, malware, or inappropriate content.

8. Intellectual Property

All content, trademarks, logos, software, and materials within the App are the property of ASRA Pain Medicine and/or its licensors and are protected by applicable intellectual property laws.  Any unauthorized use is strictly prohibited.

Users who purchase a Subscription are granted a limited, non-exclusive, non-transferable license to use the App for personal and/or authorized business purposes during the Term of their fully paid Subscription. This license shall terminate at the end of the then current Term following a cancellation of your Subscription.

9. Privacy

Your use of the App is also governed by the ASRA Pain Medicine Privacy Policy, which explains how information is collected, used, and protected.

10. Modifications to the App

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without liability.

11. Disclaimer of Warranties

The App is provided “as-is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the App will operate without interruption or error.

12. Limitation of Liability

To the maximum extent permitted by law, ASRA Pain Medicine shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the App or the Subscription. The extent of ASRA Pain Medicine’s liability for any claim under these Terms of Use shall not exceed the amount of Subscriptions fees paid by the user in the preceding year. 

13. Termination

We may suspend or terminate access to the App if a user violates these Terms of Use or engages in conduct harmful to the App or other users.

14. Governing Law

These Terms of Use shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.
